These Terms of Service ("Terms") govern your use of the WeBuild Co website at webuildco.com.au and the services provided by WeBuild Co ("we", "us", "our"). By accessing our website or engaging our services, you agree to these Terms.

1. Services

WeBuild Co provides AI automation consulting and engineering services, including but not limited to:

Agentic AI system design and implementation
Workflow automation and AI agent systems
Voice agent and CRM integration builds
Strategy sessions and system audits
Ongoing monitoring and optimisation

All services are subject to a separate project agreement or statement of work agreed upon before commencement.

2. Enquiries

Booking a call or submitting an enquiry does not create a binding agreement. Engagements are reviewed on a case-by-case basis. We reserve the right to decline any project at our discretion.

3. Fees and Payment

All fees are quoted in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise
Payment terms are outlined in each project agreement
Strategy sessions require payment prior to the scheduled call
Project deposits are non-refundable once work has commenced
Late payments may incur additional charges as outlined in your project agreement

4. Intellectual Property

Your content: You retain ownership of all business data, brand assets, and content you provide to us during a project.

Our deliverables: Upon full payment, you receive ownership of the custom systems, code, and configurations built specifically for your project. We retain the right to use general methodologies, frameworks, and non-proprietary components in future work.

Open-source components: Some solutions may incorporate open-source software. These components remain subject to their respective licences, which are identified in your project documentation.

5. Confidentiality

We treat all client information as confidential. We will not share your business processes, data, or project details with third parties without your explicit consent, except where required by law.

6. Warranties and Disclaimers

We deliver projects with professional care and skill consistent with industry standards
AI systems are probabilistic by nature — we do not guarantee 100% accuracy in all outputs
We build guardrails and human-in-the-loop safeguards, but ultimate responsibility for business decisions remains with you
Our website and content are provided "as is" without warranties of any kind

7. Limitation of Liability

To the maximum extent permitted by Australian law:

Our total liability for any claim arising from our services shall not exceed the total fees paid for the specific project in question
We are not liable for indirect, consequential, or incidental damages including lost profits, data loss, or business interruption
We are not responsible for third-party service outages (API providers, hosting platforms, etc.)

8. Termination

Either party may terminate a project agreement with 14 days written notice. Upon termination:

You will be invoiced for all work completed up to the termination date
We will provide all deliverables completed to that point
Pre-paid amounts for uncompleted work will be refunded on a pro-rata basis

9. Use of Website

You agree not to:

Use our website for any unlawful purpose
Submit false or misleading information through our booking or contact channels
Attempt to gain unauthorised access to our systems
Scrape, copy, or reproduce our website content without permission

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be resolved in the courts of New South Wales.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to active clients. Continued use of our website after changes constitutes acceptance of the updated Terms.
